Medical law

Company law

In the company law area, we offer advice (including on restructuring practices) as well as representation and negotiation services for group practice agreements, partial group practice agreements, practice group agreements, cooperative ventures, the acquisition and sale of practices, and medical treatment centers. We will also protect your interests if a partner leaves the practice or if the practice is involved in a company law dispute. In addition, we will represent you in any cases brought before regular courts and courts of arbitration.

Tax law

Company law and tax experiments are not advisable – especially when you are setting up or taking over a practice. Our team of lawyers, tax advisers and auditors is highly familiar with the particular tax problems affecting the medical professions – the conflict between self-employed professional activity and entrepreneurial status, statutory supervision, the rules of professional conduct and specific billing issues – and will find an ideal solution that meets your individual expectations.

Labor law

In the area of labor law, we can help you draft and interpret agreements such as consultant/head of department contracts, employment contracts for doctors employed by medical treatment centers, contracts for locums and residents, and practice staff contracts. We are also pleased to attend contractual negotiations if required.

Medical liability / medical criminal law

In the area of medical liability and medical criminal law, we work with specialists and experts who defend clients against claims for damages pain and suffering brought by patients. They also defend doctors against accusations of criminal offenses (treatment errors, breach of doctor-patient confidentiality, billing problems, sponsoring, etc.), representing them in dealings with public prosecutors’ offices or in court – right up to all stages of proceedings before the Bundesgerichtshof (the Federal Court of Justice).

Rules of professional conduct

This also covers representation in matters relating to the rules of professional conduct, such as legal disputes before the Medical Association or professional disciplinary tribunals and administrative courts. We defend our clients in these areas against accusations concerning breaches of professional conduct, e.g. unlawful advertising, the granting and revocation of licenses to practice, the recognition of professional titles, and the authority to provide continuing professional development.
